Stretch to Win Canada – Participation Agreement 

PLEASE READ CAREFULLY — THIS IS A LEGAL CONTRACT THAT AFFECTS YOUR RIGHTS.

BY REGISTERING, YOU AGREE TO THESE TERMS. CERTAIN CLAUSES ARE HIGHLIGHTED FOR YOUR ATTENTION.

1. Parties
   This Agreement is between Stretch to Win Canada, Inc. (“we,” “our,” or “STW Canada”) and you (“Participant”), the individual registering for and attending the Fascia Stretch Therapy™ Level 1 (FST-I) course (“the Course”).
   Only individuals (not companies) may register, and the registered individual must personally attend.
   
   
2. Purpose & Scope of Practice
   This Course trains you to apply Fascia Stretch Therapy™ (FST™) techniques to clients within your lawful professional scope of practice.
   It is not medical training and does not authorize you to:

• Diagnose, treat, or cure medical conditions unless licensed to do so under Canadian law.
  
• Teach, mentor, or train others in FST™ methods without prior written permission.
  
• Represent yourself as a licensed healthcare provider unless you hold such credentials.
  
  

3. Certification & Intellectual Property
   Your FST™ certification does not expire. However, only FST Community Members who have completed an annual live or online FST skill update exam will be listed on the official FST Practitioner Locator.

At no point may you use STW Canada’s or Stretch to Win’s intellectual property (including course materials, methods, trademarks, or logos) to teach, train, mentor, coach, or build a business training others in FST™ techniques without prior written permission.

For clarity, “teaching” includes:

• Any instruction, mentoring, or coaching (in-person or online) to individuals or groups.
  
• Any demonstration of FST™ techniques (including modifications, adaptations, or variations) exceeding 60 seconds in duration, whether live or recorded.
  
• Posting, publishing, or otherwise making available any visual, written, or audio representation of the FST™ system that enables others to learn it.
  
  

Any breach of this section results in immediate termination of your license to use our IP, without refund, and we reserve the right to seek injunctive relief in addition to any other remedies.

4. Health & Medical Clearance
   By registering, you confirm that:

• You are in good health and physically able to participate.
  
• You have no medical condition or limitation that would make participation unsafe.
  
• You have consulted a physician if you have any doubt.
  You accept full responsibility for monitoring your health during the Course and will stop immediately if you experience pain, discomfort, or distress.
  
  

5. Consent & Safe Touch Policy
   FST™ is hands-on and may involve physical contact, including stretching, mobilizing joints, and guided movement.
   By registering, you CONSENT to such contact for learning and practice. You have the right to:

• Withdraw consent at any time.
  
• Request modifications to your participation.
  If you feel uncomfortable, please inform the instructor immediately.
  
  

6. Code of Conduct & No Abuse Policy
   We are committed to a safe, respectful, and inclusive learning environment.
   Any verbal, physical, or sexual abuse, harassment, or discriminatory behaviour towards instructors, staff, or participants will result in immediate removal from the Course without refund, at our sole discretion. 
   
   
7. Assumption of Risk, Waiver & Release
   By participating, you acknowledge and agree that:

• The Course involves physical activity and carries inherent risks, including injury.
  
• You voluntarily assume all risks associated with participation.
  
• To the fullest extent permitted by law, you release and forever discharge STW Canada, its owners, officers, employees, contractors, affiliates, and the Stretch to Win Institute from any and all claims, liabilities, damages, or expenses arising from your participation, except where caused by gross negligence or intentional misconduct.
  
• You agree to indemnify and hold harmless STW Canada from any claims, losses, damages, or costs (including legal fees) arising from your breach of this Agreement or your actions during or after the Course.
  
  

8. Limitation of Liability
   To the maximum extent permitted by law:

• STW Canada’s total liability to you for any claim, loss, or damages shall not exceed the total amount you paid for the Course.
  
• We are not liable for indirect, incidental, special, or consequential damages, including lost income or opportunities.
  
  

9. Injunctive Relief
   You acknowledge that any breach of our intellectual property rights or teaching restrictions may cause irreparable harm not compensable by money damages alone. In such cases, we may seek and obtain immediate injunctive relief from a court of competent jurisdiction, without the need to post a bond.
   
   
10. Governing Law & Jurisdiction
    This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
    You agree that the courts of the Province of Alberta will have exclusive jurisdiction over any disputes arising from or relating to this Agreement, and you irrevocably submit to the personal jurisdiction of such courts.
    
    
11. Entire Agreement & Survival
    This Agreement is the complete and exclusive understanding between you and STW Canada regarding your participation in the Course.
    Sections relating to intellectual property, indemnification, limitation of liability, and injunctive relief will survive termination of this Agreement.
